Candidate Terms and Conditions for Childcare, Educational, Domestic, and Household Staff

Introduction and Definitions

These Terms and Conditions ("Agreement") govern the legally binding relationship between you ("You" or "Candidate") and Bel-Rose International ("the Agency"). This Agreement applies to your engagement with the Agency for the purpose of seeking employment in childcare positions (including nannies, governesses, etc.), educational roles (such as tutors, teachers, etc.), domestic service, and other professional household staff roles. These roles may be based in private households, yachts, functions, events, and similar settings, both within the UK and internationally.

By registering with the Agency and/or accepting any offer of work sourced through the Agency, you agree to be legally bound by the following terms:

1. Candidate Registration and Documentation

1,1 Registration

Registration with the Agency is free of charge. No registration fee or upfront payments shall be required from the Candidate at any stage of the registration process.

1.2 Documentation

You must provide accurate, complete, and up-to-date documentation at the time of registration, when requested by the Agency and prior to any introduction with Clients (e.g., interviews) and commencing work. This includes but is not limited to:

  • Provide a comprehensive Curriculum Vitae  detailing your work history, reasons for gaps, qualifications, skills etc., with all applicable dates.
  • Provide copies of all original documentation.
  • Valid identification documents (passport, right to work in the UK or respective country).
  • Enhanced Disclosure and Barring Service (DBS) certificate or equivalent international background check where applicable.
  • Valid Paediatric First Aid certification (where applicable).
  • Relevant qualifications and  professional references.
  • Any other documents required for compliance with UK law, host country regulations, or the Agency’s policies.

Failure to provide accurate, incomplete and verifiable documents may result in immediate termination of this Agreement and removal from our register.  

2. Agency Role

  • The agency acts exclusively as an introduction and recruitment intermediary between Client and candidate.
  • Under no circumstances shall the Agency be deemed the employer of the candidate.
  • The employer is the Client who  offers and controls the Candidate terms of employment.
  • The Agency does not have any control over the day-to-day work or working conditions. All related employment decisions, to include working hours, duties and responsibilities, salary, holiday entitlement, sick leave, compassionate leave, termination, but not limited to, are the responsibility, solely by the Client, and not the Agency. 
  • Following a successful interview between the Candidate and Client, all related employment decisions will be clarified in a contract of employment provided by the Client.

3. Scope of Work

  • You understand that you may be introduced for roles in private homes, on board yachts, at functions and events, or similar settings, as stated in the introduction of this Agreement.
  • The Nature of work will vary according to the Client's specific requirements and the role offered. 
  • Candidates acknowledge that the Agency introduces them to Clients across a wide range of childcare, educational, domestic, professional and household settings.
  • Candidates acknowledges that the Agency makes no guarantee in relation to the type of work or location beyond that which is provided at registration or at any stage through the recruitment process. 

4. Communication and Agency Updates

  • The Candidate agrees to keep the Agency promptly informed regarding interviews arranged and outcome, all job offers, employment (placement) changes, and any relevant communication with potential or current Clients.
  • The Candidate must not circumvent the Agency by contacting Clients directly without written permission from the Agency.
  • Any communication or engagement with the Client outside of the Agency, and without their knowledge or consent that leads to offered or accepted work breaches of this Agreement will incur liability for Agency fees. 

4. 1 Placement Fees 

All placement, introductions and agency fees are the sole responsibility of the Client. There is no placement fee for the Candidate. 

  • The Candidate acknowledges and agrees that they cannot commence employment with the Client, or travel and start work for international roles until the Agency has received all applicable fees by the Client for the service provided.
  • The Candidate acknowledges that the Agency reserves the right to withold confirmation of placement until payment of fees has been paid in full. Any work commenced prior to such confirmation is undertaken solely at the risk of the Candidate. 
  • The Agency reserves the right to delay, or cancel any placement, if the Client has failed to pay the Agency fee, without liability to the Candidate.  As above, commencement of placement  prior to confirmation is solely at the risk of the Candidate.
  • Candidates acknowledge and accept adhere to the above. See section 5

5. Fee Avoidance and Limitations of Liability

  • If a Candidate accepts a position with a Client who was introduced by the Agency, but does so in a manner that bypasses the Agency's placement process, in order to avoid the payment of Agency fees, the Candidate will be liable for full Agency fees  as is required by the Client.
  • To clarify the purpose of this clause, "bypassing the Agency" includes, but is not limited to: accepting direct contact with a Client to negotiate employment outside the Agency's knowledge; accepting a role with a Client previously introduced by the Agency within a period of (12) months from the date of introduction; or colluding with a Client to avoid the Agency's fee structure.
  • Any unpaid debts arising from such fee avoidance shall be referred to a third-party debt recovery company. The Candidate shall be liable for all costs incurred in the recovery of such debts, including legal fees and applicable collection charges.

6. Professional Conduct and Standards

6.1 General Professional Conduct

  • The Candidate agrees to maintain high standards of work performance consistent with the role and work contract.
  • The Candidate agrees to maintain the highest of standards of professional conduct at all times when representing the Agency and when interacting with Clients.
  • The Agency operates a strict  zero-tolerance policy in regarding rude, disrespectful, or bullying behaviour toward any Agency consultant. Any such behaviour may result in termination of this Agreement and removal from the Agency's register. However, in the event of Fee Avoidance and Limitations of Liability in section 5 and Placement Fees in section 4, if applicable, you will still remain liable for such fees.
  • The Candidate shall be patient and understanding regarding delays in overseas contracts, or visa processing, but not limited to, and recognise that such delays are beyond the control of the Agency and the Client.

6.2 Cultural Awareness and Respect

  • The Candidate agrees to demonstrate cultural awareness and sensitivity at all times  when working in private homes, yachts, functions, events or any other similar setting, respecting the customs, traditions and values of the Client and their household.
  • The Candidate shall treat all members of the Client's household, staff and associates with dignity and respect.

6.3 Honesty and Loyalty

  • The Candidate shall agree to act with complete honesty and integrity and in all dealings with the Agency, the Client and the nature of the household, yacht, event, function or similar setting.
  • The Candidate shall demonstrate loyalty to the Client's interests and shall not engage in any activity that could potentially perceived as contrary to the Client's best interest.

6.4 Dress and Presentation

  • The Candidate agrees to dress appropriately and professionally at all times, in accordance with the standards expected by the Client and the nature of the role required within households, yachts, events, functions or similar settings.
  • The Candidate is expected to maintain high standards of personal hygiene; to be clean and tidy in appearance , and shall present themselves as a positive role model at all times.

6.5 Privacy and Confidentiality

  • The Candidate agrees to maintain strict privacy and confidentiality regarding all matters pertaining to the Client, the Client's family, household staff, associates and guests.
  • The Candidate shall not disclose any confidential information, including but not limited to personal details, financial information, private conversations, household routines, or security arrangements, to any third party without the express written consent of the Client.
  • The Candidate shall not post, share, or publish any information, photographs, videos, or content on any social media platform, website, or public forum that could bring shame, disgrace,  or embarrassement, or reputational harm to the Client, Client's family, or the Agency.
  • This confidentiality obligation shall survive the termination of this Agreement and any subsequent employment relationship with the Client.

7. Safety, Welfare and Due Diligence

7.1 Child Safety and Welfare

  • The Candidate agrees to prioritise the safety, well-being and best interests of any children within their care at all times.
  • The Candidate must remain vigilant and proactive in safeguarding children within the household. This includes adhering to the family’s guidelines, maintaining clear and respectful communication, and immediately reporting any concerns or unusual incidents to the client or appropriate authorities. Continuous awareness and sensitivity to children's needs are essential despite the absence of formal sector regulations.

7.2 Working with Other Household Staff

  • The Candidate is expected to foster a professional, cooperative, and respectful working environment with fellow household staff. Clear boundaries and open communication help ensure smooth operations and maintain mutual respect. Collaboration supports overall household welfare and contributes to a positive working atmosphere.
  • The Candidate agrees to report any signs or concerns regarding the behaviour, conduct, or suitability of any other member of staff to the Client or appropriate authority's safeguarding team or the police, without delay.
  • The Candidate shall cooperate fully with any investigation carried out by statutory authorities relating to safeguarding matters.

7.3 Due Diligence and Best Practices

Given the lack of statutory frameworks governing private household roles, the  Candidate is advised to:

  • Thoroughly review and clarify job expectations and responsibilities with the client before commencing employment.
  • Maintain ongoing, transparent communication regarding any welfare or safety concerns.
  • Engage in self-directed learning about best practices in child welfare and workplace conduct.
  • Keep accurate records of significant incidents or communications relevant to their role.
  • Seek guidance or legal advice when uncertain about any aspect of their duties or rights.

By proactively implementing these measures, the Candidate can uphold high standards of safety and professionalism, protecting themselves and those within the household.

8. Insurance

  • The Candidate is strongly advised to obtain public liability insurance prior to commencing employment.
  • The candidate accepts that the Agency does not provide public liability insurance coverage, and accepts no liability for any losses or claims arising from the Candidates failure to obtain appropriate insurance (for any purpose).

9. International Placements

  • The Candidate is solely responsible for researching the destination country for international placements, including but not limited to local customs, laws, security and safety conditions, cultural norms, language considerations and challenges.
  • The Candidate is responsible for obtaining all necessary inoculations and vaccines, and medical clearances for international travel and residence. Associated costs are covered by Client and usually, reimbursed on proof of receipt. 
  • Regarding visas, work permits, and residence permits, the Candidate is responsible for ensuring they have all the necessary legal documentation required to work in the destination country.
  • While the Client typically covers visa application fees and flights for international placements, the Agency makes no guarantee or warranty regarding these arrangements.

The Agency strongly advises Candidates to ensure they feel confident, safe and comfortable with the  country and role prior to acceptance.

You acknowledge and accept with full understanding that working internationally can present isolation, cultural barriers, and logistical challenges, and it is your responsibility to prepare accordingly.

The Agency does not accept liability for failure to meet overseas legal requirements or for any consequences arising from inadequate due diligence on the Candidate’s part.

10. Employment Contracts and Terms of Engagement

Once a role is accepted by both the Candidate and Client, the Candidate shall enter into a separate employment contract with the Client.

The employment contract between the Candidate and the Client shall include, but not limited to, provisions regarding:

  • Specific duties and responsibilities of the role.
  • Working hours and schedule.
  • Salary, benefits and allowances.
  • Holiday entitlement and leave.
  • Accommodation.
  • Notice periods and terms of notice.
  • Any other terms agreed by both parties.

The Agency shall not be a party to the employment contract and accepts no liability for any disputes arising from its terms and performance.

11. Data Protection and Privacy

  • The Agency will process the Candidate's personal data in accordance with applicable data protection laws. The candidate's data will be used solely for the purposes of registration, introductions to Client's and placement administration.
  • The Candidate consents to the Agency sharing their annonymised CV (surname, contact details removed) and a summary to Clients for consideration for the role they are seeking to fill as part of the introduction process.
  • The Candidate consents to the Agency sharing their full CV to include contact details, qualifications, references, and background results with Clients on offer of employment (placement) should the Client request.
  • The Candidate consents to sharing their contact phone number or similar for interviews to take place. 
  • The Candidate's personal data will be held for a period of (6) years following the last contact with the Agency, unless a longer retention period is required by law.

12. Limitation of Liability

The Agency shall not be liable for any loss, damage or expense incurred by the Candidate arising out of or in connection with any introduction, placement,  or employment arrangement , including but not limited to:

  • Any failure to comply with the employment terms of contract.
  • Any injury, illness, or loss suffered by the Candidate during the course of employment.
  • Any delays or costs associated with international placements, to include UK placements.

The Agency's total liability to the Candidate shall not exceed the total amount of any fees paid by the Candidate to the Agency  (if any).  Given that registration is free, the Candidate acknowledges that the Agency's liability is limited to a nominal sum of £1.00 unless otherwise required by law.

13. Term and Termination

  • This agreement shall commence upon the Candidate's acceptance of these terms and conditions and shall remain in effect until terminated by either party in accordance with this clause.
  • The Agency reserves the right to terminate  this Agreement immediately, without notice, if the Candidate breaches any term of this Agreement or engages in conduct that the Agency reasonably considers to be detrimental to its reputation or interests.
  • The Candidate may terminate this Agreement at any time by providing written notice to the Agency.
  • Clauses relating to confidentiality, fee avoidance, debt recovery, and liability shall survive the termination of this Agreement.

14. Governing Law and Jurisdiction

  • This Agreement shall be governed by the laws of England and Wales.
  • Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Entire Agreement

  • This  Agreement constitutes the entire agreement between the Candidate and the Agency regarding its subject matter and supersedes all prior agreements, understandings, and representations.
  • No variation of this Agreement shall be effective unless made in writing and signed by both parties.
  • The Agency reserves the right to amend these Terms and Conditions at any time. Candidates will be notified of any changes by email.
  • In the event any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Acknowledgement and Acceptance

  • By signing below the Candidate acknowledges they have read, understood and agree to be bound by all the terms and conditions set forth in this Agreement.
